David Riordan has dragged Uber to Cook County Circuit Court last week, after its driver reportedly used the company’s app to find the passenger’s home address, which he stormed to beat him to a pulp.
The incident reportedly occurred on on Dec. 18, 2016 at about 2 a.m, after David Riordan ordered the Uber ride home after leaving a Christmas party in Chicago’s Wicker Park, according to court documents.
According to him, he was picked up in a Honda Accord by a driver named Munstr Abuseimi, who became aggressive, kicked Riordan out of his car, and then got out and punched Riordan in the face and tackled him.
After the attack, Riordan went to a friend’s home afterwards and reported the incident to Uber about 2:30 a.m. He then called another Uber to take him home, according to the suit.
Riordan said when he got to his home in Logan Square, Abuseimi was there waiting and attacked him with a metal rod from behind.
According to the suit, Abuseini told Riordan “Don’t f— with Uber drivers,” during the attack.
In the suit, Riordan claims that the ambush left him with a fractured left orbital, bleeding in his brain, concussion and a dislocated jaw with nerve injury. He said he also had to get nine stitches.
Although, Abuseini was arrested Jan. 23 in Lake View and subsequently charged with aggravated battery with a deadly weapon, according to Chicago Police. His bail was set at $75,000 and he was released from Cook County Jail after posting bond, according to court records. He has pleaded not guilty to the charges.
On why he’s suing Uber, Riordan told TMZ that he thinks the company is prioritizing profits over rider safety by not sufficiently screening its drivers.
His lawyer, Ian Alexander of Goldberg and Goldberg, also said they tried to settle the case with Uber, but they’ve been unresponsive.
The suit accuses Abuseini of battery, assault and causing Riordan emotional distress during the attack. It also accuses Uber of negligently hiring and supervising Abuseini.
